Uh, prior to our… going to open public comment. Uh, please join me in a moment of silence, in remembrance of Tim Evans. The husband of select woman Laura Evans. On behalf of the Select Board, I extend our Deepest condolences to Laura and her family. We hold them in our thoughts and offer our support as they grieve.

Thank you, Don. Thank you, Selectmen Southern. Anyone else? Seeing none, may I have a motion? Sure, I've got that one. I moved the board a point. Tom Flowery, to the Rights of Way Committee for a turn to expire. June 30th, 2029, subject to the board's… Committees, commissions, membership policy. Okay, you've heard the motion. Is there a second? Moved and check. Any further discussion? Seeing none, roll call vote. Selectman Seller? Alright. Select my bracket. Aye. Suckman Valentine. Okay. Hi. And select my Murphy votes aye, and the motion passes for 0. All right. Thank you very much, Tom.

16:12

Thank you all very much. Back aboard. Have a good evening. Take Okay, moving right along to our second interview of the evening, it's, uh… Interview and consideration of appointment to the FinCom. Margo. Hitlian, is she here? Yes, she is. This is, how are you? Well, good evening, everyone. Good evening. Just wondering if you could give us a little bit of, uh… Background, and uh… on you so that people on the board certainly know. But people who are listening, just to know where you've been and where you're coming from, and things of that nature. Certainly. So I'm a licensed CPA in Massachusetts and California. I was appointed to the board a year ago this time. I came before you

17:04

Shortly after I was appointed to the Finance Committee, I learned that the town of Rockport hired my firm, Clifton Larson Allen, or CLA, to audit the town. So given that was a conflict of interest, I resigned immediately upon learning that. Nonetheless, we're here today. The role I was filling would have been a interim role anyway, so I think I would have had to come before you To be reappointed at this time. So Second trip around the sun. I apologize for any disruption. I know Mitch wasn't necessarily very happy about that, but I had to do it in the interest of the town. Yeah. We appreciate that.

17:54

So, I'm no longer working for CLA. I haven't since May. So the start of a new fiscal year will not come into any level of conflict Great. Well, thank you again for your willingness to, uh, serve this important committee. The Finance Committee. Uh, any questions from members of the board? Uh, Justice, we're glad you're back, Margo. Thank you, Dwight. All right. I'm happy to be back, too. Okay, uh, if there are no further questions. Thank you very much again for your willingness to serve, and may I have a motion? I have the motion, Mr. Chair. I move that the Board appoint Margo Hintman. to the Finance Committee for a term to expire June 30th, 2029, subject to the Board's Committee's Commissions Membership Policy.

20:20

Do we have someone here? Mr. Chair, Dan Tuck is here to speak to it. Hi. Okay. Hi, Dan. Hey, how are you Good. Good, how are you? The floor is yours. So we're just looking to build on kind of where we started last year, decorating Harvey Park, having the fire pit, the smallest kits available. We'd like to add a second day of the horse-drawn carriage rides down Bears Canuck. It's all become very popular. We get a lot of great feedback, from… from young and old alike after the fact about how much they enjoy more things to do in town. So we just want to keep this kind of new tradition of things going. Okay, is anything changed? Other than the adding of a day. Is that the only major change?

21:07

I'm not sure. That's the only major change. I know in the original proposal, we had lights for Harvey Park, but there's some electrical issues. So that's been taken off for now. But as far as putting the wooden trees around and that stuff, we'd still like to do all that in the park And like I said, the second day for the horse carriage. Okay. Great. Okay. I can't believe we're already talking about the holidays, but that's great. Time flies. Um, but it certainly does. Any, uh, comments, questions, concerns from. Members of the board. I think it's great. Me too. Okay. Hearing none, anything else from you, Mr. Tuck? No, just looking forward to another great holiday season. Hopefully the weather will cooperate and plenty of people will be milling around.

21:53

Good, I agree with you. May I have a motion? Yes, Mr. Chair, I have the motion. I move that the Board approve The following Christmas in Rockwood events subject to all requirements of the police. December 4th to 6th. 12 through 13th, 19th through 20th, 26 through 27th. All items are to be removed, and the park is to be fully cleared.

22:39

By December 29, 2026, at 4 p.m. Control the fire pit on the above dates in one designated location. By the fire chief subject to all requirements, of the fire and police chiefs. Food trucks and the above dates, subject to the approval of parking zones by the Chief of Police. Low-volume holiday music or carolers, not both at once, On the dates above in Harvey Park. Any caroling and downtown area shall not impede sidewalks to roadways. The police and fire chiefs are authorized to stop any of the above approved items in the interest of public health and safety. 24:09

Hi, Kristen, how are you? I'm well, thanks, how are you? Good, good. Uh, what do you have planned? Okay. So we are doing our seventh annual RAM National Juried Exhibition. It's the biggest and most prestigious exhibition of the year. The exhibition opens on Saturday, November 14th, and the night before, Friday, November 13th, we have our gala and awards presentation. It's an elegant reception catered by Vinwood Caterers. We invite all of the exhibiting artists to attend, and obviously anybody from the public lovely catered food, live music, and the presentation of over $26,000 in prizes and awards. And it's also an opportunity for guests at the gala to view and purchase art before the exhibition opens to the public the following day.

25:02

It's $100 a ticket. It's a fundraiser for the Rockport Art Association and Museum. As I said, it's exhibiting artists and people from Cape Ann dressed to the nines, enjoying a lovely evening, and we would like to have We would like to have the TIPS certified bartenders on staff at Vinwood serve alcohol, please. Okay. Is… is this just, uh, artwork in terms of paintings, or is there other art as well? Gotcha. Okay. Wonderful. It's paintings, photographs, sculptures, graphics, collage. Pretty broad array of medium. Beautiful. Okay, anything different? From previous years? Okay. No? Nope, it's always a lovely affair. It's that Friday the 13th from 6 to 8. It's a really, it's a really nice time and a lot of the artists from all over the country who attend say that Rockport is

25:59

Perhaps the most beautiful place they've ever been to, and that the reception is top-notch and one of the best they've ever seen. And so we're quite proud of it. That never gets old hearing that, that's great. Oh, thank you. Yep. Any comments from or questions or concerns from members of the board? Okay, seeing none, may I have a motion? I have that, Mr. Chair. I move the board approve… The one-day alcohol license for the Rockport Art Association Gala. an awards reception on November 13th, 2026, from 6 to 8 p.m. Subject to full compliance with the alcohol regulations as amended and any requirements, of the police, fire, health, inspectional Services departments.

26:45

Per the motion, is there a second? Moved and seconded. Further discussion? Seeing none, roll call vote. Select them southern. Bye. Select my bracket. Aye. Uh, Slackman Valentine. And select my Murphy votes aye, and the motion passes 4-0. Thank you. All right. Okay, thank you very much But, yep. All right, you're all set. Alrighty, good luck. Thank you so much. Yeah, good night. Good night. Thank you. Okay, moving on to the next item on the agenda. Long Beach wall replacement. Um, is there anyone here? Um, yes.

27:30

Not shown: public comment or a passage with personal details (27:30 to 28:25). Watch the video for this part.

28:25

To do it, and Dana from the Conservation Commission has been over there and seen it, and I don't know a few people in front of you have… I took pictures of it, and yeah. Yes. But, so I figured I'd just take… I know it's your land, but I figured I'd just take it upon myself to, just replace it, because I don't want anybody to get hurt, and I don't want the whole thing to fall over in my neighbor's yard No, that's very kind. Um, any questions from the board? Nope. Good idea. Okay. All right. Anything else, Jerry? Nope, that's it. I just don't know where to go. If you approve it, then I must I have to go back to the conservation Yes, yeah. Commission, I guess, to get a permit to do it. Okay, so I just called John

29:10

Not shown: public comment or a passage with personal details (29:10 to 29:57). Watch the video for this part.

29:57

All set, Jerry. All right. Okay, moving right along to. Um, the state election warrant. Um, do we have anything, any update on that, Mitch? Uh, standard requirement, um, pretty ministerial and straightforward in this particular case, it's a state election, so it's carrying forward the warrant the state provides. Okay, good. Any questions from the board? Hearing none, may I have a motion? Yes, Mr. Chair, I move that the board approve the issuance of the November 3rd, 2026 state election warrant. Second. Okay, move and second. Any further discussion? Seeing none, roll call vote. Selectman-Southard. Alright. Select my bracket.

30:42

Aye. Selecting and Valentine. And select member if he votes aye. Excuse me, and the motion passes 4-0. Okay… Right? Mr. Chair, your next batch, um, are, uh, generally interrelated. They need individual votes, but items 5 through 9 are all related to contracts for DPW so DPW director Aaron Shalufo is here to speak to each one. As we go along, he can give a little bit of context. These are all bids I want to recognize the hard work that He and the team in DPW put into getting all of these contracts out to bid every one of these represented an RFP and a detailed process that exists with that. So he's prepared to give you a summary as it relates to each one as you work your way through.

31:35

Okay, wonderful. Thank you. Mr. Shilufo, are you on? Can we… there's Aaron. Hi, Aaron. How you doing? How are we? Good, how are you? I'm doing all right. You want to start with the first one? This… Sure. If So basically, we put out 4 bids for on-call services contract or invitation to bid 27-02 is construction services. So that's basically construction labor and equipment for a various needs that the town may have. It could be anything from water main installation to drainage installation. So, the way that was bid, we plan on awarding to the top two contractors.

32:23

Which will be in Grenice and Sons and JP Cardillo. Okay. Okay, do you have any recommendation on that, or…? So it's… Sorry, yes for both. Yeah. Okay, sir. Recommended, recommended for both. So Okay, wonderful. Okay, uh, great, uh… Any discussion from the members of the board? Uh, just a quick question, Aaron, uh, the estimated quantities in the bid year is 500,000. How did we get to that number? Yep. So because it's an on-call service, we have to come up with, we do have to come up with an estimated number. That doesn't mean we will use that full amount, because we may or may not use it based on our needs. Obviously, we went over it with our general counsel

33:09

Reviewed it, they were okay with the way it was set up. So we will, based on our needs, every project that we say that we want to work for, they will give us Mm-hmm. This all speaks to correct an estimate, and then they will perform the work based on that estimate, or based on… based on the bid prices. Right. And this is also just an important note on this particular one, it emergency and non-emergency work. So it addresses both sides of it, which is why it's, you know, certainly been on the higher side that they part that on-side of it. Right, right, no, no, I understand I was inferring that, actually. Yeah, thank you. Okay, anyone else? Seeing none, may I have a motion? I have that one, Mr. Chair. I move the board approve.

33:56

The on-call construction equipment rental and Services contract bid as presented by the DPW Director. Okay, uh, you've heard the motion. Is there a second? Moved and second, any further discussion. Seeing none, roll call vote. Select movements southern. Second. Select my bracket. Hi. Aye. Select my Valentine. and select McMurphy votes aye, and the motion passes 4 0. Okay, next. Next. Um… The CTV and jet vac cleaning. Yep. Hi. Next one, again, yes, CCTV and jet vac equipment and, equipment and services. This will allow us, if we have, any issues with either sewer or drainage, to be able to

34:46

to look at that as needed. The recommendation from our consulting engineer is to award to the top 3 contractors, all three of them, and then based on the needs, utilize the one that would be the most cost-effective for the town. The three contractors are BMC Corporation National Water Main and rapid flow Thank you. Any discussion from members of the board? Good. I have another question about… I'm curious about how the decisions are made to Um, or how… The consultant comes up with those recommendations. Are these… are these outfits that we've done business with before? Yep. Through my career, I've done business with them before. The only one I haven't done business in a while with is Rapid flow. That was a number of years ago in a different community.

35:43

Again, based on the needs of the town or what the scope of the project is, we would accommodate to the lowest because it's almost like, I'm going to call it a menu of different items, and based on what we… the needs are, we will select those items and utilize the contractor that's the most cost-effective. Okay, great. Thank you. Okay, uh, any other questions? Hearing none, may I have a motion? I have the motion. I move that the Board approve the on-call closed circuit television and jet back cleaning equipment. Rental and services contract bid. As presented by the DPW Director. Second. Moving second. Any further discussion?

36:29

Seeing none, roll call vote. Selectman Souther. Select my bracket. Aye. Selectman Valentine. And select member votes aye, and the motion passes for 0. Catch basin cleaning contract. Hi. Yep, again, another on-call contract. This time based on the bids, the recommendation from our consulting engineer was toward it to the lowest bidder of BMC Corporation for $39,846 Okay, and this is for all the catch basins in town? Yes. Okay. How many do we have off the top? Do you know?

37:16

I think it's I think it's about 800. I'm sorry. Wow, well, okay. Well, okay. Any. discussion, or any comments from the board? Seeing none, may I have a motion? Yes, Mr. Chair, I move that the Board approve The on-call catch-basing cleaning clamshell and jetvac. contract bid as presented by the DPW Director. Second. Moved and second. Any further discussion? Seeing none. Roll call vote, uh, Selectmen Southern. Bye. Second bracket. Aye. I was select when Valentine. And select member if he votes aye, and the motion passes 4-0.

38:02

And… The next one is pipelining and manhole rehab contract. All right. And this would be for sewer pipelining and manhole rehab. On-call contract, based on the bids, our consulting engineer recommended awarding to, National Water Main For one year. At a million dollars Just over a million dollars Thank you. Any comments or questions from the board? Seeing none, may I have a motion? I have that one, Mr. Chair. I move the board approve. Hmm.

38:47

The on-call pipelining and manhole rehab contract bid as presented by the DPW Director. Okay, is there a second? Second. Well, that's okay. I have a sorry Paul, I have a question. I'm looking at the document and it says the estimated cost for this on-call work is based on the estimated quantities in the bid year. Is $150,000. In year one. I'm sorry, that's right. I apologize. Yeah, the total bid Was a potential of a million dollars, but based on based on what we feel that we would we may do We will award for a lesser amount, and then if it goes over, we'll reaward again based on the based on the bids.

39:40

Let me let me just Okay, so we're looking to approve… A million on… Let me just let me just double check the contract. on conditional. Let me grab it real quick. I apologize. The contract award amount is for $250,000.

40:26

Okay. Thank you. Any other comments? Yeah, just as a follow-up on that, so once we arrive at 250, you have to come back to the board for further approvals? Is that how it works? The It's… well, my understanding of it is based on the on-call services, so when you award a contract for this, you want to try to give an estimate of what you're going to spend for money And that's what they put their bonding and insurance on. All it means is if we go over that we would make them resubmit insurance and bonding for the amount they need

41:15

And we would have to come back, but yes, and we would have to come back and redo a contract. Yes. Thank you. Anyone else? Seeing none, may I have a, um… Motion, please. It was already made and seconded, Mr. Chair. Oh, I'm sorry, it means. Um… Roll call vote. Suckman-Souther. Hi. Select mid bracket. Aye. Uh, Selectmen Valentine. And select member if he votes aye, and the motion passes 5… 4-0. Very good. Thank you, Aaron.

42:00

Okay, we have a surplus declaration of a Ford van from the public schools. Hi. Thank you, Aaron. Um, anything you want to add, uh, Mitch? So this is the van that was used by their food service department to basically shuttle. food between the actual full kitchen in the high school over to the elementary school where it was finished prep and served. That fan is, as you can tell from, you know, some of the feedback, it is beyond its useful life and in condition that is, uh, Um, beyond repair. It's basically, like, some of the other vehicles that you've determined as scrap, it's completely rusted out, and it's beyond the point that the mechanics feel is safe to operate. Um, the mechanics' memo basically told us internally that

42:45

stop use right away on it. So, um, that's what's happened. not something that, um… It would be worthwhile repairing. So you see Dr. Branco's memo for your consideration on scrapping. Yeah. Okay. Any discussion from the members of the board? Seeing none, may I have a motion? Yes, Mr. Chair, I move that the Board deem the vehicle currently identified as a school food service van, a 2006 Ford E-Series cargo van, A surplus and authorize the DBW to scrap said vehicle. Second? Second, any further discussion? Seeing none. Roll call vote, uh, Selectmen Southern. Bye. Select my bracket. Aye.

43:30

Uh, Selectmen Valentine. And select my Murphy votes aye, and the Um, motion passes 4-0. Okay, last on our action list is KP Law Joint Representative Caleb. Cable negotiations, Mitch, do you wanna? Hi. Tackle this. Thank you, Mr. Chair. So. Hmm. as we have done for the last three, I believe, Comcast cable license renewal processes, we have done that as a region. We've done that in partnership with Gloucester, Manchester, and Essex. That's also in line with our public access structure. As everyone is aware. 1623 Studios is the public access provider for the group. Uh, so the recommendation for you is to continue in that path as a group, and in order to do so, KP Law, which represents Rockport, Manchester, and Essex, needs permission from each of the towns to be

44:32

able to jointly represent for the purpose of cable negotiations. Ten years ago, the Board gave its approval for this as well, and I know it had been done prior. But our request is… your authorization for that. Gloucester has its own in-house counsel, so they will be handling the cable negotiations for them, but the intent is KP Law will represent, subject to your approval, Rockport, Manchester, and Essex. And there are separate contracts, so there's no You know, one gets better than the other, or that harms somebody else, they're… they're all individual contracts is just bargaining as a group. How long have a contract, what are the options? cable licenses are 10 years. Then, okay. And do we anticipate any major changes?

45:21

Too early. Yeah. Okay. I think we will need to see where we're several months away from being able to do that. This is really kind of step one in that. We haven't ascertainment process upcoming shortly, which will brief you about at a future meeting. Great, thank you. Any, uh, questions from the board, or concerns or comments? Okay. Seeing none, may I have a motion? I have the motion. I move that the Board approve the Joint Representation Agreement for KP Law to regionally represent Rockport. Essex and Manchester by the sea. and cable license negotiations as presented. Second? Talking any further, excuse me, discussion. Seeing none, roll call vote. Selectmen Southern. It's like my bracket. All right.

46:06

Aye. Select and, uh, Valentine. And select my Murphy votes aye, and the motion passes. Hi. 4, 0. Okay. Moving on to letter G. Select Board and Town Administrator updates. Mitch, do you want to take the first one? Thank you, Mr. Chair. Been a busy few weeks. The a great highlight from the last few weeks is the Council on Aging and the Board of Health jointly offered a program on mental health first aid for older adults. This was a day-long seven and a half hour program focused on educating the participants on addressing mental health challenges that arise, whether it's in the workplace or in the community or with one's family. So this was really well received for those participants. It was led by the

47:00

regional social worker for the Eastern Essex Regional Public Health Coalition, which Rockport is a partner in. So utilizing these regional resources to help, um, address that. Additionally, the assistant COA director from Hamilton supported Jesse Palm, the social worker, uh, on that. So these are, these are programs that are focused, and they take place kind of throughout the country, and there are different ways. There's a youth-focused mental health first aid, there's a General Mental Health First Aid, there's a seniors-focused mental health first aid. This was the first time we've had this and it included participants, there were 19 participants. They included a variety of community members and the managers that were associated with the three harbor like congregate living facilities in town, which was very helpful. I think it was beneficial for those folks.

48:01

Um, so, uh, that was, that was a positive. There were also nine licensed nurses and a social worker who were present for it. So certainly folks who are all have a connection somehow, whether they live or have a professional connection to Rockport. Uh, so beneficial and a great first step forward on this program, we do intend on offering the general mental health first aid for town employees in the next couple of months now that we know that this worked out well and it was well received, we will offer it for Those employees' upcoming. Additionally, we had three very successful required trainings relating to open meeting law, public records, and conflict of interest. The two in-person sessions were very well attended. One of them was 80-plus.

48:51

individuals. The online one was also very well attended. So we were glad that folks got through there. There's a small batch of folks who, for a variety of reasons, couldn't make it. So there will be a makeup session. for that small group that we need to get through. So the intention will be, uh, every few years, we'll have this particular type of class, uh, available for folks, and this is a, uh, this is to supplement, not supplant, the state-required trainings that that need to take place on an annual or every two-year basis. But I think an important and helpful engagement opportunity with Council. Do other municipalities doing this as well, I would imagine.

49:36

Oh, this is, um, yeah, this is a very common thing. I can't speak to frequency, but I know that the, um… Uh, package of materials that was presented is a, a very typical package that's done statewide by KP Law. So since these supplemental funding approval for the town hall project, we are continuing to, uh, finalize things in the bid as the board is aware, we were at 95% design, uh, going into, uh, the town meeting. Uh, we're working on getting that last 5% done. We will have a number of Uh, items for the board to decide in the next couple of weeks, paint color and a few other designs for in the building.

50:21

Now that, uh, and with the intention of getting a bid package out shortly, Rob and Steve and DPW have really been focused on making sure that moves forward appropriately and getting things squared away on that front. Additionally, now, again, that the money is approved and it's real, We are finalizing the relocation assignment for Town Hall departments. As the board is aware, the majority, or all of it, I should say, all of the public-facing departments will transfer over to the annex, and we'll have more detailed information on that as we get closer. In the next few weeks, we're getting ready to have some internal meetings on timings and things like that, so departments can start to prepare.

51:05

There'll be a lot of space sharing at the annex, it'll tight quarters, but it will be the one-stop shop. You know, when we leave that building, that'll get a fresh coat of paint, that'll get some fix-ups and tweaks, so, uh, separate from this project, but that'll get some general cleanup after we're there, and everybody will have a better space, not only town hall, but the separate from it as a close out as we transition out of there, the annex will get some TLC as well, um. And we have a number of open capital projects there, the windows getting cleaned up, things of that nature, the roof, all pre-approved projects, which we will take care of during that time frame. More to come on that once we have some internal meetings, making sure everybody's on the same page.

51:51

We're looking forward to, uh, getting that going and the question that we have gotten nearly daily is, well, when's the move gonna be? So we're… we're this close to being able to publicly share that date. We just need to have a few more conversations, and our internal teams need to get a few more things finalized, and then we will. share on very specific transition timing for things. That's all I have, Mr. Chair. So you're gonna… they're gonna entrust us with picking the colors? Did I get that right? We, since it's not one of those renovations that has a lot of, um, uh, changes in structure, uh, colors and general designs, there are, there's a list of general design matters that we would present to the board for your consideration. Our intent

52:35

My understanding… my understanding that's right up selectman Southerd's. Okay. I'm a mauve guy, I want mauve. Allie, he'll be terrific. Yeah, love, yeah. Yep. Yeah. You know, our… our intent is to go simple and straightforward, like we shared at town meeting. Uh, you know, right now, if you come in, there are four town hall colors. If you were to go to ACE and say, I want town hall blue or town hall green, They produce a special color for you. We're looking to move away from that and get things standardized, cleaned up. Um, and in a way that makes life a lot easier for DPW on the maintenance end as well. We'll have a few pallets for you to pick from that, the flooring color. There'll be no more rugs in the building, and the uniform flooring throughout. So a handful of items on what the building will look like for your consideration.

53:27

That's exciting. Okay, anything else, Mitch? That's it, Mr. Chair, thank you. Okay, a couple things that I want to bring up prior to, um… And going on to other members, uh, we want to thank the, Rockport Fire Department for their, uh, quick action on the. Um, Monday… Sunday the 20th of September, when the House of Pizza and the building of the apartments above. on fire. Uh, it was great. effort by the Rockwood Fire Department, as well as mutual aides far away as Lynn. This was the largest fire in Rockwood, my understanding, since 1982. Uh, when the church, Methodist Church caught on fire.

54:13
